Homeowners Guide to Building and Renovating

Welcome to Phoenix Built

At Phoenix Built, we believe that building or renovating your home should be an exciting and rewarding experience. As a trusted construction company in New Zealand, we are committed to transparency, professionalism, and delivering high-quality craftsmanship. Understanding your rights as a homeowner is key to ensuring a smooth process, and this guide is designed to help you make informed decisions every step of the way.

Consumer Protection Measures for Homeowners

If you're considering a residential building project, you should know the consumer protection measures that exist to safeguard your investment. These measures promote a professional, no-surprises relationship between homeowners and contractors.

Key protections include:

  1. Written Contracts – Required for any residential work costing $30,000 or more (including GST). At Phoenix Built, we recommend contracts for all projects to ensure mutual clarity.

  2. Disclosure Statements – Contractors must provide information about their qualifications, experience, and any insurance or warranties they offer before signing a contract. See our Disclosure Statement here

  3. Prescribed Checklist - Building contractors are required to provide you a copy of the Prescribed Checklist to help you become informed, see here for a copy

  4. Completion Documents – Once your project is finished, your contractor must provide details about maintenance, warranties, and any ongoing insurance policies.

  5. Defect Repair Period – You have an automatic 12-month period where any defects in workmanship must be fixed at no cost.

  6. Implied Warranties – Even if not explicitly stated in your contract, the Building Act provides warranties that last for up to 10 years.

  7. Penalties for Non-Compliance – Contractors can face fines if they fail to meet legal requirements.

At Phoenix Built, we adhere to all these regulations to provide you with a hassle-free experience and peace of mind.

Before Building Work Starts

Planning & Budgeting

Having a clear budget and priorities will help guide the entire process. Work with a Licensed Building Practitioner (LBP) like Phoenix Built to ensure your project meets all requirements.

Getting Quotes

  • Obtain detailed quotes from reputable contractors.

  • Ensure quotes include a breakdown of labour, materials, and GST.

  • Compare the scope of work, materials, and fittings to ensure a fair comparison.

  • If a quote seems too high or too low, ask for an explanation.

At Phoenix Built, we pride ourselves on our pricing transparency and prefer to price towards a fixed price contract, If you would like a free no obligation quote or help with your upcoming project call us now to discuss.

Understanding Contracts

Your contract should clearly outline:

  • Project scope and timeline

  • Materials and labour costs

  • Payment schedules

  • Responsibilities for obtaining building/resource consents

  • Dispute resolution processes

  • Warranty and maintenance obligations

💡 Tip: Always review the contract carefully and seek legal advice if needed.

During Construction

Selecting Materials

Material choices impact quality and durability. Ask your builder:

  • Why they recommend certain materials

  • If they receive any incentives for sourcing from specific suppliers

  • About alternative options to fit your budget without compromising quality

Variations to the Contract

Changes during the build should always be documented and agreed upon in writing to avoid unexpected costs and delays.

Restricted Building Work (RBW)

RBW includes work on the primary structure, weathertightness, and fire safety systems. Only Licensed Building Practitioners (LBPs) can perform or supervise these tasks. Phoenix Built is fully licensed to carry out RBW, ensuring compliance and quality.

Once Building Work is Complete

Completion Documents

After finishing your project, Phoenix Built will provide:

  • A copy of any applicable insurance policies

  • Details on warranties for materials and services

  • Maintenance instructions to keep your home in top condition

Defect Repair Period (12 Months)

If any defects arise within 12 months, notify us in writing, and we will rectify them promptly.

Final Inspections & Code Compliance

Your project isn’t complete until the final Code Compliance Certificate (CCC) is issued. We ensure all work meets the required standards and provide the necessary documentation.

If Issues Arise

Step 1: Talk to Your Contractor

Misunderstandings are common in construction. Start by reviewing your contract and discussing concerns directly with your builder.

Step 2: Follow the Dispute Resolution Process

Your contract should outline the steps for resolving disputes. Phoenix Built prioritizes fair and professional resolution.

Step 3: Seek Mediation or Legal Action

If disputes cannot be resolved through direct communication, mediation services, the Disputes Tribunal, or the District Court may be necessary.

The Benefits of Using a Master Builder or Certified Builder

Choosing a builder who is a member of either the Registered Master Builders Association or the New Zealand Certified Builders Association comes with added benefits and assurances:

  1. High Standards – Members must meet strict quality and experience criteria.

  2. Workmanship Guarantees – Master Builders provide a 10-Year Master Build Guarantee, while Certified Builders offer the Halo 10-Year Residential Guarantee.
